Claims submission

Notice of Claim

An individual who suffers material damage, as a result of a fault by Ville de Châteauguay, can file a notice of claim for compensation.

The notice must be addressed to the Direction du greffe et du contentieux de la Ville de Châteauguay by mail, fax or e-mail :

The notice must mention:

  • first and family names of the claimant;
  • claimant's address;
  • cause of the damage;
  • date and location of the incident;
  • details of the claim.

Material damage

The concept of "material damage" refers to damage to both moveable property (example, an automobile) as well as damages to immovable property (example, a house). There must be a direct link between the alleged fault by the municipality and the damage for which the municipality is being held accountable.

Notice
The City must receive written notice within 15 days following the date of the incident. See articles 585 and 586 of the Cities and towns act.

Limitation
Legal action for damage may be undertaken no later than 6 months from the date of the incident.
